Shapline sells, in particular, 3D printing files, plans, digital models, electronics projects, diagrams, programs, scripts, source code, firmware, images, graphic representations, manuals, technical documentation and other content supplied in digital form.

These Terms of Sale set out, in particular, the conditions for ordering, payment, delivery and use of these Digital Products.

They must be read together with the General Terms of Use, legal notice, privacy policy and, where applicable, any special conditions appearing on the product page of each Digital Product.

For the purposes of these Terms of Sale, the following terms have the meanings set out below.

“Customer”

Any natural or legal person placing an order on the Website.

  • 3D printing file ;
  • STL, OBJ, STEP, CAD, DXF, 3MF file or equivalent ;
  • digital plan or model ;
  • electronics project ;
  • electrical or electronic diagram ;
  • printed circuit board file ;

  • bill of materials ;
  • digital archive containing several files ;
  • update or derivative version of a Digital Product.

“Source File”

Any file included in a Digital Product, regardless of its format.

“Derivative Creation”

“Standard License”

The personal, limited right to use a Digital Product in accordance with these Terms of Sale and any special conditions displayed on its product page.

Article 3 – Purpose and scope

These Terms of Sale apply exclusively to Digital Products sold by Shapline.

In particular, they govern:

  • the presentation of Digital Products ;
  • the formation of the contract ;
  • payment ;
  • supply and downloading of files ;
  • the license granted to the Customer ;
  • restrictions on use ;
  • intellectual property ;
  • the statutory guarantee of conformity ;
  • the handling of complaints ;
  • the resolution of disputes.

Where a Digital Product is subject to special conditions, they supplement these Terms of Sale.

In the event of a conflict, the special conditions prevail solely for the Digital Product concerned.

Any physical products offered on the Website are not governed by these Terms of Sale and must be subject to separate terms of sale.

Article 4 – Acceptance of the Terms of Sale

Before placing an order, the Customer must be able to consult and expressly accept these Terms of Sale.

Confirming an order implies full acceptance of:

  • these Terms of Sale ;
  • the General Terms of Use ;
  • the characteristics of the Digital Product ;
  • its price ;
  • its file formats ;
  • its technical prerequisites ;
  • the applicable Standard License ;
  • restrictions on reproduction and commercial exploitation.

The Customer acknowledges having read this information before paying for the order.

The applicable Terms of Sale are those in force when the order is placed.

Shapline retains proof of the version of the Terms of Sale accepted by the Customer.

Article 5 – Legal capacity

The Customer declares that they have the legal capacity to enter into a contract and make a payment.

Where a minor is permitted to place an order, it must be placed with the permission and under the responsibility of their legal representative.

A person placing an order on behalf of a company, association or other organization declares that they are authorized to bind that organization.

Article 6 – Characteristics of Digital Products

The essential characteristics of each Digital Product are presented on its sales page.

This information may include, in particular:

  • the nature of the files supplied ;
  • the number of files ;
  • available formats ;
  • approximate file size ;
  • model dimensions ;
  • compatible software ;
  • required equipment ;
  • necessary components ;
  • supported software versions, where applicable ;
  • terms of use ;
  • type of license ;
  • any special restrictions ;
  • download instructions ;
  • any included updates.

Photographs, videos, illustrations, renders, simulations and representations on the Website are intended to show the result that can be achieved using the Digital Product.

Unless expressly stated otherwise, they do not mean that the Customer will receive a physical object, a 3D print, a machine, an assembled device, electronic components or consumables.

An order for a Digital Product covers only the files expressly listed in the Product description.

Colors, textures, surface finishes, tolerances and final results may vary according to the Customer's equipment, settings, components, materials, software and skills.

Article 7 – Customer checks before ordering

Before ordering, the Customer must check that they have:

  • a device for downloading and storing files ;
  • a sufficient Internet connection ;
  • software compatible with the formats offered ;
  • a compatible operating system ;
  • an appropriate 3D printer, where required ;
  • a print bed of sufficient size ;
  • the necessary materials ;
  • the necessary electronic components ;
  • suitable tools ;
  • the necessary technical knowledge and skills ;
  • sufficient storage space.

The Customer is invited to contact Shapline before ordering if they have doubts about a Digital Product's compatibility with their equipment.

Incompatibility with equipment, software or a version not advertised as compatible does not necessarily constitute a lack of conformity of the Digital Product.

This provision does not limit the statutory guarantee of conformity where information supplied by Shapline was inaccurate or insufficient.

Article 8 – Ordering process

The Customer selects the Digital Product(s) they wish to purchase and adds them to their basket.

Before final confirmation, they can check:

  • the selected Products ;
  • quantities ;
  • prices ;
  • any discounts applied ;
  • the total amount ;
  • their personal information ;
  • their email address ;
  • their payment method.

The Customer must correct any error before confirming their order.

Final confirmation must be made using a button displaying the words:

“Order with obligation to pay”

or equivalent wording clearly indicating that placing the order entails an obligation to pay.

The order becomes final only after:

1. acceptance of these Terms of Sale;

2. acceptance of the conditions governing immediate performance of the contract;

3. confirmation of payment;

4. confirmation of the order by Shapline.

Article 9 – Refusal or cancellation of an order

Shapline may refuse, suspend or cancel an order for legitimate reasons, including:

  • payment failure ;
  • suspected fraud ;
  • fraudulent use of a payment method ;
  • manifestly incorrect information ;
  • an abnormal order ;
  • previous infringement of Shapline's rights ;
  • unauthorized sharing or distribution of files ;
  • an attempt to circumvent a security measure ;
  • exceptional unavailability of the Product ;
  • an obvious error relating to price or description.

Where Shapline cancels an order that has been paid for before the Digital Product is supplied, the amounts received are refunded, except in cases of proven fraud or another legally applicable provision.

Article 10 – Prices

Prices are stated in euros.

They include legally applicable taxes, unless otherwise clearly indicated before the order is confirmed.

The applicable price is the price displayed when the order is placed.

Shapline may change its prices at any time. A subsequent change does not affect orders already confirmed.

Any discounts, promotions or temporary offers are valid only during their advertised period and subject to the stated conditions.

In the event of an obvious pricing error, particularly where the price is negligible compared with the Product's usual value, Shapline may cancel the order and refund the Customer.

Article 11 – Payment

Payment is due immediately when the order is placed.

Accepted payment methods are displayed on the Website at checkout.

Payment may be processed by a specialist service provider. Shapline does not necessarily have access to the Customer's full bank card details.

The Customer warrants:

  • that they are authorized to use the selected payment method ;
  • that the information provided is accurate ;
  • that they have the necessary funds or authorizations.

An order is supplied only after payment has been confirmed.

If payment is refused or cancelled, access to the Digital Product may be denied or suspended.

Article 12 – Order confirmation

After the order has been confirmed, Shapline sends the Customer confirmation on a durable medium, generally by email.

This confirmation includes or provides access to, in particular:

  • Shapline's identity ;
  • the order number ;
  • the order date ;
  • the Digital Product ordered ;
  • the price paid ;
  • these Terms of Sale ;
  • download information ;
  • License conditions ;
  • confirmation of consent to immediate performance ;
  • confirmation of acknowledgment of the loss of the right of withdrawal.

The Customer must provide an accurate, accessible email address.

They must also check their spam or junk mail folders.

Article 13 – Supply of Digital Products

Unless otherwise stated, the Digital Product is supplied following payment confirmation:

  • by download from the Website ;
  • from the Customer's Account ;
  • via a secure link ;
  • by email ;
  • or by another method specified when ordering.

Supply is deemed to have taken place when:

  • the file is made available to the Customer ;
  • the download link is sent to the Customer ;
  • or the Product is made available in their Account.

The download may be immediate or take place within the period announced on the Product page.

Where no specific period is announced, Shapline supplies the Digital Product without undue delay after payment confirmation.

Article 14 – Downloading and storage

The Customer must download the files within a reasonable period after they are made available.

They must keep a personal, secure copy of every Digital Product purchased.

The Customer is advised, in particular, to:

  • back up files on several storage devices ;
  • protect their Account and login credentials ;
  • check the integrity of downloaded archives ;
  • retain proof of purchase ;
  • keep the version of the Terms of Sale received.

Shapline may allow repeated downloads from the Customer's Account, without this necessarily creating an obligation to provide unlimited storage.

Shapline may temporarily restrict downloads in the event of:

  • automated activity ;
  • an abnormal frequency of downloads ;
  • suspected Account sharing ;
  • attempted bulk extraction ;
  • a security risk.

A Customer acting in good faith may contact Shapline to request that access be restored.

Article 15 – Right of withdrawal before supply

As a rule, the Consumer has fourteen days from conclusion of a distance contract to exercise the right of withdrawal.

However, this right may be lost for digital content not supplied on a tangible medium where performance of the contract begins before the end of the withdrawal period, provided the legal requirements of Article L. 221-28 of the French Consumer Code are met.

The right of withdrawal is not automatically lost merely because the Product is digital.

Article 16 – Immediate performance and loss of the right of withdrawal

To obtain immediate access to the Digital Product, the Consumer must, before the file is supplied:

1. give prior express consent to performance of the contract beginning before expiry of the fourteen-day period;

2. expressly acknowledge that they will lose their right of withdrawal once performance begins;

3. receive confirmation of their consent and acknowledgment on a durable medium.

In particular, the Consumer must agree to statements equivalent to the following:

“I expressly request that the supply of digital content begin immediately, before the end of the statutory fourteen-day withdrawal period.”

and:

“I acknowledge that by gaining immediate access to the digital content, I lose my right of withdrawal.”

Where these conditions are met and downloading or access to the Digital Product has begun, the Consumer can no longer withdraw merely because they have changed their mind.

Consequently, no refund will be granted for the following reasons:

  • the Customer has changed their mind ;
  • the Customer no longer needs the file ;
  • the Customer does not like the Product ;
  • the Customer no longer wishes to complete the project ;
  • the Customer ordered the wrong Product by mistake ;
  • the Customer lacks the necessary equipment despite the prerequisites being stated ;
  • the Customer does not know how to use the required software ;
  • the Customer encounters difficulties caused by their own settings ;
  • the Customer believed they would receive a physical object although the digital nature of the Product was clearly stated.

This exclusion of the right of withdrawal does not deprive the Consumer of the statutory guarantee of conformity or any other mandatory rights.

Where the legal conditions for loss of the right of withdrawal have not been properly met, the Consumer retains the rights granted by law.

Article 17 – No physical returns

As Digital Products are not supplied on a tangible medium, they cannot be returned by post.

Where a refund is legally due, Shapline may deactivate download links and require the Customer:

  • to delete all copies of the Digital Product ;
  • to cease all use of the Product ;
  • to stop using Derivative Creations where termination of the contract so requires ;
  • to confirm deletion in writing.

A refund never constitutes permission to retain or exploit the Digital Product.

Article 18 – Nature of the purchase and no transfer of copyright

Purchasing a Digital Product does not transfer any intellectual property rights.

The Customer does not acquire ownership of the work, project, model, program, code or source file.

The Customer acquires only:

1. a digital copy of the Product ordered;

2. a limited, non-commercial Standard License for personal use.

Shapline or the relevant rights holders retain, in particular:

  • reproduction rights ;
  • rights of public communication ;
  • adaptation rights ;
  • modification rights ;
  • translation rights ;
  • commercialization rights ;
  • distribution rights ;
  • the right to grant licenses ;
  • the right to create and exploit derivative works.

All rights not expressly granted to the Customer are reserved.

Article 19 – Copyright protection

The Digital Products offered by Shapline, including projects, files, images, programs, scripts, code, 3D printing files, plans, models, representations, documentation and technical files, are protected by intellectual property and copyright law.

This protection covers:

  • complete Products ;
  • their components ;
  • their source files ;
  • their structure ;
  • their organization ;
  • their graphic elements ;
  • their documentation ;
  • their intermediate versions ;
  • their updates ;
  • their adaptations ;
  • their extracts ;
  • identifiable elements derived from them.

Any unauthorized representation, reproduction, adaptation, modification, transformation, translation or distribution is prohibited, subject to mandatory exceptions provided by law.

Payment for a Digital Product does not grant any reproduction or exploitation rights beyond those expressly provided by the Standard License.

Article 20 – Standard License for personal use

Unless otherwise indicated on the Product page, Shapline grants the Customer a Standard License that is:

  • personal ;
  • individual ;
  • non-exclusive ;
  • non-assignable ;
  • non-transferable ;
  • non-sublicensable ;
  • limited to private use ;
  • excluding any commercial or professional exploitation.

Subject to compliance with these Terms of Sale, the Customer may:

  • download the Product onto personal devices ;
  • keep private backup copies ;
  • consult the files and documentation ;
  • use the Product to complete a project for personal use ;
  • 3D-print a reasonable number of copies exclusively for personal use ;
  • assemble an electronics project for personal use ;
  • use the program or script within the expressly permitted personal context ;
  • publish photographs of a completed creation provided they do not disclose files, plans, dimensions, diagrams or information enabling the Product to be reproduced.

The Standard License is granted to the Customer identified when the order is placed.

It may not be shared with household members, friends, colleagues, employees, a team, an association, a school, a makerspace or a business without Shapline's written authorization.

Article 21 – Prohibition of reproduction and sharing

Unless expressly authorized in writing by Shapline or permitted by a mandatory statutory exception, it is prohibited:

  • to copy a Digital Product for a third party ;
  • to send a file to another person ;
  • to share a download link ;
  • to share Account login credentials ;
  • to give, lend, rent or exchange a file ;
  • to publish a file online ;
  • to send a file by email or messaging service ;
  • to place a file in shared storage ;
  • to offer a file on a download platform ;
  • to distribute a file on a forum or social network ;
  • to post a file on Discord, Telegram or a similar service ;
  • to share a file by torrent or peer-to-peer network ;
  • to upload a file to a marketplace ;
  • to include a file in a shared library ;
  • to include a Product in training materials or a document database ;
  • to make the Product available to a service provider without authorization.

The prohibition applies whether sharing is free or paid, public or private.

Article 22 – Prohibition of modification

Unless expressly permitted on the Product page or by a mandatory legal provision, it is prohibited:

  • to modify files ;
  • to transform models ;
  • to adapt plans ;
  • to modify images ;
  • to alter a program, script or code ;
  • to translate or convert files for distribution ;
  • to reverse-engineer ;
  • to decompile or disassemble a program ;
  • to extract a substantial part of the Product ;
  • to remove a signature or author attribution ;
  • to remove a watermark ;
  • to remove an order identifier ;
  • to circumvent a protective measure ;
  • to create a derivative version intended for sharing or sale.

Technical operations strictly necessary for expressly permitted personal use, such as slicing an STL file, generating supports or adjusting print settings, grant no rights over the original file.

Where personal adaptation is permitted, it remains subject to these Terms of Sale.

The Customer may neither share nor commercialize the modified version.

A modification, even a substantial one, does not make the Customer the author of the original Product or create any right of commercialization.

Article 23 – Prohibition of resale of Digital Products

Under no circumstances may the Customer:

  • resell purchased files ;
  • sell a copy of the Product ;
  • resell a modified version ;
  • offer the Product in an archive or bundle ;
  • commercialize an extract ;
  • distribute the Product free of charge to promote an activity ;
  • transfer the License ;
  • grant a sublicense ;
  • offer the Product on a marketplace ;
  • charge for access to the Product ;
  • include the Product in a subscription or paid training course.

Resale of a Digital Product remains prohibited even if:

  • the Customer retains no copy ;
  • the file has been modified ;
  • the file has been converted into another format ;
  • the Product is sold with other files ;
  • the Product is marketed under another name ;
  • the author or Shapline brand is not mentioned.

Article 24 – Prohibition of commercial sale of 3D prints

Purchasing a 3D printing file does not authorize the Customer to sell objects printed from that file.

Unless a separate written commercial license has been granted, the Customer may not, in particular:

  • sell a 3D print ;
  • sell multiple prints ;
  • manufacture objects to order ;
  • offer a printing service using the file ;
  • sell a print on a website ;
  • sell a print on a marketplace ;
  • sell a print at a trade fair, market or exhibition ;
  • provide a print in exchange for payment or another benefit ;
  • incorporate the print into another product for sale ;
  • sell a spare part printed from the file ;
  • commercialize a modified version of the object ;
  • use the file for craft or industrial production ;
  • use the file as part of a paid repair activity ;
  • manufacture batches, even limited ones.

This prohibition applies to:

  • prints identical to the original model ;
  • resized prints ;
  • modified prints ;
  • painted or decorated prints ;
  • prints assembled with other parts ;
  • prints incorporated into a more complex object ;
  • prints made from another material.

The Customer therefore may not trade, directly or indirectly, in 3D prints produced using files sold by Shapline.

Article 25 – Prohibition of commercializing projects and derivative creations

Unless a written commercial license has been granted, the Customer may not trade in projects or creations made using Digital Products.

In particular, it is prohibited to sell:

  • an assembled electronics project ;
  • a printed circuit board based on the files ;
  • a device using the supplied program or code ;
  • a machine or mechanism built from the plans ;
  • a kit containing the project files or components ;
  • a prototype based on the Product ;
  • a spare part made from the plans ;
  • a derived representation or image ;
  • software incorporating the code or script ;
  • training explaining or reproducing the project ;
  • documentation reproducing the plans or instructions.

The prohibition also covers:

  • rental ;
  • manufacture to order ;
  • provision of a paid service ;
  • receipt of mandatory donations ;
  • crowdfunding ;
  • indirect sales ;
  • advertising monetization primarily based on the Product ;
  • exploitation within a business.

Use may be considered commercial even if the activity has not yet generated a profit.

Article 26 – Printing and manufacturing service providers

The Customer may transfer a Source File to a printing, manufacturing or assembly provider only if Shapline expressly authorizes this.

Where such transfer is authorized:

  • the provider acts solely on the Customer's behalf ;
  • it may fulfill only the Customer's personal order ;
  • it may not retain the file longer than necessary ;
  • it may not reuse the file ;
  • it may not transmit it to a third party ;
  • it may not add the file to its catalogue ;
  • it may not sell additional copies.

The Customer remains responsible for transferring the File and must inform the provider of these restrictions.

Article 27 – Commercial licenses

Commercial use is permitted only where a separate commercial license is:

  • offered on the Product page ;
  • ordered and paid for by the Customer ;
  • or granted in writing by Shapline.

A commercial license may specify, in particular:

  • its duration ;
  • its territory ;
  • the number of authorized objects ;
  • the number of users ;
  • permitted sales channels ;
  • permitted modifications ;
  • credit and attribution obligations ;
  • subcontracting restrictions ;
  • renewal conditions.

Purchasing a Standard License must never be interpreted as implicitly granting commercial rights.

Oral permission or an informal exchange does not constitute a commercial license without clear written confirmation from Shapline.

Article 28 – Use by a company or organization

Unless special conditions apply, the Standard License is intended for one natural person only.

Use by:

  • a company ;
  • an association ;
  • a government body ;
  • a school ;
  • a university ;
  • a makerspace ;
  • a shared workshop ;
  • a team ;
  • several employees or collaborators ;

requires Shapline's prior consent and, where appropriate, purchase of a suitable license.

An order placed in a company's name does not automatically grant commercial exploitation rights.

Article 29 – Artificial intelligence and databases

Without Shapline's written authorization, it is prohibited to use Digital Products or their components to:

  • train an artificial intelligence system ;
  • feed a generative model ;
  • create a dataset ;
  • generate embeddings ;
  • evaluate or fine-tune a model ;
  • automatically create derivative works ;
  • integrate files into a training database ;
  • enable a third party to perform these operations.

This prohibition covers, in particular, images, 3D models, plans, diagrams, code, text and documentation.

Article 30 – Marking and traceability

Digital Products may contain protective or tracking measures, including:

  • an order number ;
  • a Customer identifier ;
  • a visible or invisible watermark ;
  • a digital signature ;
  • metadata ;
  • an individualized marking ;
  • a technical fingerprint.

These elements are intended to protect Shapline's rights and identify the source of a copy distributed without authorization.

The Customer must not remove, modify or neutralize these elements.

Shapline may also retain technical information about connections and downloads in accordance with personal data protection laws.

Article 31 – License violations and legal proceedings

Any use of a Digital Product outside the rights expressly granted may constitute:

  • a breach of contract ;
  • copyright infringement ;
  • an act of counterfeiting or infringement ;
  • unfair competition ;
  • or any other offense or wrongful act under applicable law.

In the event of a breach, Shapline may, in particular:

  • suspend the Customer's Account ;
  • deactivate download links ;
  • terminate the License ;
  • demand that use cease immediately ;
  • request deletion of the files ;
  • request removal of unlawful listings or content ;
  • report the breach to relevant platforms ;
  • send formal notice ;
  • seek compensation ;
  • bring civil or criminal proceedings ;
  • seek reimbursement of legally recoverable costs ;
  • request any measure to end the infringement.

Suspension of an Account or termination of a License does not release the Customer from liability for damage caused.

Shapline reserves the right to seek full compensation for proven loss.

Article 32 – Compatibility and printing results

Results may vary depending on:

  • the 3D printer ;
  • slicing software ;
  • settings ;
  • calibration ;
  • material ;
  • nozzle diameter ;
  • temperature ;
  • print speed ;
  • infill ;
  • supports ;
  • humidity ;
  • machine tolerances ;
  • changes made by the Customer.

Shapline does not guarantee that a file will produce results identical to the presentation images with all equipment and settings.

The Customer remains responsible for configuration, monitoring the print and checking the resulting part.

This provision does not limit the statutory guarantee where the file itself is defective or does not conform to its description.

Article 33 – Electronics projects and safety

Some Digital Products require the use of:

  • electronic components ;
  • batteries ;
  • power supplies ;
  • heating tools ;
  • a soldering iron ;
  • cutting tools ;
  • machines ;
  • chemicals ;
  • mechanical parts ;
  • live electrical equipment.

The Customer must have the necessary knowledge and comply with applicable safety rules.

In particular, the Customer must:

  • check wiring ;
  • verify voltages and polarity ;
  • use appropriate components ;
  • follow manufacturers' instructions ;
  • wear necessary protective equipment ;
  • ensure adequate ventilation ;
  • keep children and animals away ;
  • stop use immediately if overheating, smoke or unusual odors occur.

Unless expressly stated otherwise, projects are not designed for use in:

  • a medical device ;
  • life-support equipment ;
  • a safety system ;
  • a vehicle in traffic ;
  • an aircraft ;
  • a critical industrial installation ;
  • any application where failure could cause death, serious injury or major damage.

The Customer is responsible for assembly, selected components, modifications and regulatory compliance of their use.

Article 34 – Technical support

Shapline may provide support concerning:

  • downloading ;
  • opening an archive ;
  • identifying files ;
  • a reproducible defect affecting the Product ;
  • general information stated in the documentation.

Unless a specific service is purchased, a Digital Product does not include:

  • personalized training ;
  • full configuration of the Customer's equipment ;
  • development of a custom version ;
  • correction of an assembly built by the Customer ;
  • remote software installation ;
  • repair of a 3D printer ;
  • supply of components ;
  • unlimited assistance.

Shapline may ask the Customer to provide:

  • the order number ;
  • a precise description of the problem ;
  • screenshots ;
  • software name and version ;
  • error messages ;
  • the settings used ;
  • any information necessary for diagnosis.

Article 35 – Statutory guarantee of conformity for digital content

The provisions of this Article apply to consumer Customers.

Information box on the statutory guarantee of conformity

A Consumer has two years from supply of digital content or a digital service to enforce the statutory guarantee of conformity if a lack of conformity arises.

For one year from the supply date, the Consumer need only establish the existence of the lack of conformity, not when it first appeared.

The statutory guarantee of conformity entails an obligation to provide all updates necessary to maintain the conformity of digital content or the digital service.

The statutory guarantee of conformity entitles the Consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without significant inconvenience.

The Consumer may receive a price reduction while retaining the digital content or service, or terminate the contract and obtain a full refund in exchange for relinquishing the digital content or service, if:

1. Shapline refuses to bring the digital content or service into conformity;

2. conformity is restored only after an unjustified delay;

3. conformity cannot be restored without imposing costs on the Consumer;

4. restoring conformity causes significant inconvenience to the Consumer;

5. the lack of conformity persists despite an unsuccessful attempt to remedy it.

The Consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination.

In that case, the Consumer does not have to request that conformity be restored beforehand.

Where the lack of conformity is minor, the Consumer is entitled to cancellation of the contract only if the contract does not require payment of a price.

Any period during which the digital content or service is unavailable so that conformity can be restored suspends the remaining guarantee period until conforming content or a conforming service is supplied again.

These rights arise under Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A trader who, in bad faith, obstructs the enforcement of the statutory guarantee of conformity is liable to the penalties provided by the French Consumer Code.

The Consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect.

This warranty may entitle the Consumer to a price reduction if the Digital Product is retained, or a refund in exchange for relinquishing the Digital Product.

Article 36 – Enforcing the statutory guarantee

To request enforcement of the statutory guarantee, the Consumer may contact Shapline at:

contact@shapline.com

Where possible, the Consumer should provide:

  • the order number ;
  • the Product concerned ;
  • the nature of the defect ;
  • the circumstances in which it occurs ;
  • the software and equipment used ;
  • error messages ;
  • any screenshots or files allowing the problem to be reproduced.

Shapline may offer, in particular:

  • a new download ;
  • replacement of a corrupted file ;
  • a corrected version ;
  • instructions for resolving the issue ;
  • an update ;
  • any other solution that brings the Product into conformity.

Waiving the right of withdrawal does not prevent the Customer from exercising the statutory guarantee of conformity.

Article 37 – Situations not necessarily constituting a lack of conformity

Subject to the circumstances and the Consumer's statutory rights, the following do not necessarily constitute a defect in the Digital Product:

  • incompatibility with equipment not advertised as compatible ;
  • incompatibility with an unsupported older software version ;
  • user error ;
  • incorrect print settings ;
  • improper calibration ;
  • use of unsuitable material ;

An update may, in particular:

  • fix an error ;

Improvements that add new features or constitute a new major version may be offered separately where they are not necessary to maintain the original Product's conformity.

The Customer must install necessary updates communicated to them within a reasonable period.

Shapline is not liable for a defect resulting solely from failure to install an update where the Customer was properly informed of its availability and the consequences of not installing it.

Article 39 – Shapline's liability

The chosen mediator must be listed by the French Commission for the Assessment and Monitoring of Consumer Mediation.

The Consumer remains free to accept or reject the solution proposed by the mediator.

Article 46 – Applicable law

These Terms of Sale are governed by French law.

The choice of French law does not deprive a Consumer resident in another country of any more protective mandatory provisions applicable to them under the law relevant to their situation.

Article 47 – Competent courts

Where a dispute involves a Consumer, territorial jurisdiction is determined in accordance with applicable mandatory rules.

No provision of these Terms of Sale requires the Consumer to bring proceedings exclusively before a court far from their home where the law allows another court to hear the case.

For disputes between Shapline and a Business Customer, jurisdiction is assigned to the competent courts for Shapline's registered office or establishment, subject to any contrary mandatory rule.

  • legal changes ;
  • changes to the Website ;
  • new Products ;
  • new features ;
  • changes to payment methods ;
  • new protective measures.

The Terms of Sale applicable to an order are those accepted when that order was placed.

A subsequent amendment does not retroactively reduce rights lawfully acquired by the Customer.

Article 50 – Partial invalidity

If a provision of these Terms of Sale is declared invalid or unenforceable, the remaining provisions remain in force.

Where possible, the affected provision must be replaced by a valid provision pursuing an equivalent legal purpose.

Article 51 – No waiver

Shapline's failure to exercise a right immediately does not constitute a waiver of that right.

An occasional tolerance does not confer any permanent right on the Customer.

Article 52 – Language

These Terms of Sale are drafted in French.

They may be translated into other languages.

In the event of a conflict between versions, the French version prevails, subject to mandatory provisions applicable to the Customer.
